Welcome to Cardinator. These Terms and Conditions ("Terms") govern your download, installation, and use of the Cardinator mobile application (the "Application"). By accessing or using the Application, you agree to be bound by these Terms. If you do not agree, do not install or use the Application.
1. Scope of Service and Offline Operation
Cardinator provides a mobile utility framework designed to store loyalty cards, membership cards, transportation passes, and other types of custom cards locally on your device. The Application operates completely offline. ArsAxis provides no cloud hosting, remote synchronization, or remote database services.
2. Data Ownership and Security Responsibility
You acknowledge and agree that you are the sole owner of all data input into Cardinator. Because the Application is offline-only:
- No Cloud Backups: The developer does not back up, mirror, or retain your cards. If your device is lost, stolen, broken, or if you uninstall Cardinator, all stored card data will be permanently lost. The developer holds no liability for data recovery or loss.
- Local Security: The Application provides optional local biometric locking mechanisms (using system-level device security). You are exclusively responsible for maintaining the physical security of your device and enabling access locks to safeguard your information.
- Automated Deduplication Liability: During data restoration or peer-to-peer file imports, Cardinator utilizes localized algorithmic filters to identify and skip duplicate card structures. ArsAxis accepts no liability for items, imagery, profiles, or metadata text entries that are omitted, skipped, or merged automatically by the Application's data conflict mechanics.
3. Pro Version and Lifetime License
Cardinator offers an optional premium upgrade ("Pro Version") available as a digital product within the application store from which you downloaded the Application.
- One-Time Purchase: The Pro Version is acquired via a single, one-time payment. This purchase grants you a non-transferable, perpetual, worldwide license to utilize all premium features of the Application for the lifecycle of the product. No recurring subscription charges apply.
- Billing Platform: All financial processing is governed by the terms and policies of the application store through which you made the purchase. Refunds are subject to the standard refund eligibility guidelines established by that store platform. The developer does not directly process payments or issue transactional refunds.
4. Permitted Use and Restrictions
You are granted a limited, non-exclusive license to use Cardinator on personal mobile devices under your control. This license is revocable only in the event of your material breach of these Terms and does not affect the perpetual Pro Version license described in Section 3. You explicitly agree not to:
- Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Application.
- Modify, adapt, alter, or create derivative works based upon the software architecture or asset packs.
- Use the Application for fraudulent storage or presentation of forged identification or counterfeit items. You assume full legal liability for the validity of the documentation you digitize within Cardinator.
5. Peer-to-Peer Sharing Mechanics
The Application includes features allowing user-directed sharing of cards via localized interfaces (QR codes, NFC, or the platform's nearby-device connection framework over Bluetooth/Wi-Fi). You accept full responsibility for any information or card data you deliberately share or broadcast to other parties or companion hardware terminals. ArsAxis exerts no oversight or control over peer-to-peer transmissions.
6. Disclaimer of Warranties
The Application is provided to you on an "AS IS" and "AS AVAILABLE" basis, without warranty of any kind. To the maximum extent permitted by applicable law, ArsAxis disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. There is no guarantee that the Application will integrate error-free with every third-party optical barcode terminal or scanning device.
7. Limitation of Liability
To the fullest extent permitted by law, in no event shall ArsAxis be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of equipment functionality, or legal consequences arising out of your presentation or use of cards digitized via the software.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the developer's operating jurisdiction, without regard to conflict of law principles. Any legal disputes arising directly from these terms shall be settled within competent local courts.
